License Retention on the Road: When They Can Take It Away and How to Avoid It
During control operations conducted on national and provincial roads and access points to major cities, authorities check both mandatory documentation and compliance with traffic regulations. In certain situations, agents may order the preventive retention of the driver's license, a measure provided by legislation for infractions considered particularly serious.
The retention of the license does not automatically imply the permanent loss of the license, but it does require the driver to regularize their situation with the competent authority before recovering it. Additionally, depending on the type of infraction, fines, license suspension, or even disqualification from driving may be imposed.
Serious Infractions That Lead to Immediate License Retention
The National Traffic Law outlines various scenarios in which the authority can preventively retain the license. These include driving under the influence of alcohol or substances, significantly exceeding the maximum speed limits, driving against traffic, running a red light, riding a motorcycle without a helmet, driving without valid mandatory insurance, or operating a vehicle without the Technical Vehicle Verification (VTV) or Mandatory Technical Review (RTO) when required.
In these cases, the agent prepares the corresponding report and proceeds with the preventive retention of the license. It will be the administrative authority or the competent judge who determines the final sanction and the conditions for the return of the license. In several jurisdictions, the driver receives a citation that allows them to drive only for a limited time until they regularize their situation.
In addition to infractions committed while driving, measures may also be taken when the driver presents an expired, altered license or one that has been suspended by administrative or judicial decision. In such cases, the authority may prevent the vehicle from continuing to circulate.
Validity of the Digital License in Mi Argentina During Controls
The Digital National Driver's License, available in Mi Argentina, has the same legal validity as the physical document for driving within the national territory. The national government confirmed that it can be presented during traffic controls as long as it is valid and the QR code can be verified by the authority in charge of the operation.
The system was designed to allow validation even when the driver does not have an internet connection at the time of the control, as the application generates a QR code with a specific validity that can be read by inspectors. Nevertheless, authorities recommend updating the application before embarking on a trip to avoid inconveniences arising from outdated versions or authentication issues.
Pre-Trip Check: Safety Elements and Vehicle Condition
Before heading out on the road, it is always important to check that all mandatory documentation is up to date. In addition to the license, the driver must have the vehicle identification card, proof of mandatory insurance, and the VTV or RTO when applicable according to jurisdiction and vehicle age.
It is also essential to check the general condition of the car. The tires should have adequate tread depth and the pressure indicated by the manufacturer. Additionally, it is advisable to verify the proper functioning of the low and high beams, turn signals, position lights, and brake lights, as well as the windshield wipers, fluid levels, and braking system.
Among the mandatory safety elements are the fire extinguisher with valid charge and properly secured inside the cabin, as well as portable beacons to signal an emergency. All occupants must wear their seatbelts, and minors must use the appropriate child restraint system when required by law.
Another point that is often checked during controls is that the license plates are perfectly legible and placed in the regulatory locations. Driving with damaged, altered, or obscured plates can result in sanctions and even prevent the continuation of the trip until the situation is regularized.
