U.S. Government Supports OpenAI Copyright Lawsuit, Claims AI Training is Fair Use

The U.S. government has submitted documents to the court supporting OpenAI in its copyright dispute with publishers such as The New York Times, arguing that using news content to train artificial intelligence models aligns with the fair use principles of U.S. copyright law. The U.S. Department of Justice stated that restricting AI companies from using copyrighted content to train large language models would violate the fundamental principles of copyright law and hinder innovation and scientific progress. The New York Times filed a lawsuit against Microsoft and OpenAI in December 2023, accusing ChatGPT and Microsoft Copilot of using a significant amount of Times content to train their models and generate responses. The U.S. government asserted that AI training is highly transformative of original works and does not harm the market value of copyrighted works; tightening fair use rules could result in only large tech companies being able to afford licensing fees, thereby weakening the competitiveness of the U.S. AI industry. Relevant parties are expected to submit new motions requesting the court to rule on some core disputes after completing evidence exchanges.
